Background<\/strong><\/p>\n\n\n\n

On the one hand, a Company which\nplaced third in the final ranking of a public tender brought proceedings  disputing the admission to the tendering\nprocedure of the successful tenderer (\u201cthe Main Claim\u201d). On the other hand, the\nsuccessful tenderer requested the dismissal of the Main Claim and filed a\ncounterclaim  contending that the Company\nshould have been excluded from the public procurement procedure (the\n\u201cCounterclaim\u201d).<\/p>\n\n\n\n

The Italian Administrative Court\ngave priority to examining the Counterclaim filed by the successful tenderer\nand granted that claim. Also, because of the grant of such Counterclaim, the\nItalian Court decided to reject as inadmissible the Main Claim.<\/p>\n\n\n\n

The Company brought further appeal\nas it considered that irrespective of the Court\u2019s ruling on the Counterclaim,\nthe substance of the Main Claim should have been examined.<\/p>\n\n\n\n

The Italian case law is not clear\nabout the possibility to resolve a principal claim (such as the Main Claim)\nonce a related incidental claim (such as the Counterclaim) has been granted. <\/p>\n\n\n\n

Judgment of the Court of Justice<\/strong><\/p>\n\n\n\n

Under these circumstances, a\npreliminary ruling was referred to the Court of Justice. <\/p>\n\n\n\n

The Court of Justice declared that\nwhen two tenderers bring actions seeking their reciprocal exclusion (as occurs\nin the present case with the Main Claim and the Counterclaim), the objective of\nboth tenderers is to obtain the award of the relevant contract. This objective\nmay be achieved if the requested exclusion of a tenderer is granted and the\nappellant becomes directly awarded; or if the result of the claim is the\ncalling of a new procurement procedure in which the appellant has again the\nchance to participate and be awarded with the contract. <\/p>\n\n\n\n

The interests pursued with the\nfiling of reciprocal excluding actions are equivalent. Therefore, national\ncourts shall not be allowed to reject as inadmissible a claim (such as the  Main Claim) on the basis that national\nprocedural rules give priority to incidental counterclaims (such as the Counterclaim).\nThe grant of an incidental claim cannot be an obstacle for a national court to\nexamine the substance of the corresponding main claim and, if such main claim\nis finally granted, annul the public procurement and call for a new one. <\/p>\n\n\n\n

Finally, it is important to note\nthat this doctrine is only applicable to reciprocal excluding actions and it is\nnot contrary to the Court of Justice case law regarding the inadmissibility of\nan appeal brought by a tenderer whose exclusion has become final.<\/p>\n","protected":false},"excerpt":{"rendered":"
