Comentarios al Proyecto de Real Decreto por el que se regula el procedimiento de financiación y fijación de precios de los medicamentos en el Sistema Nacional de Salud

This article analyses the Draft Royal Decree regulating the procedure for the financing and pricing of medicinal products within the Spanish National Health System, a long-awaited initiative aimed at modernising a regulatory framework that has become increasingly outdated in light of evolving administrative practice and the growing sophistication of financing arrangements. While taking an overall positive view of the Draft Royal Decree, the article critically examines some of its key features, including the scope of administrative intervention in pricing, the articulation of financing decisions and access agreements, the protection of confidential information, the introduction of conditional financing and accelerated access mechanisms, and the regulation of prices following loss of exclusivity. Against this background, the article puts forward a number of proposals aimed at enhancing legal certainty, predictability and efficiency within the future regulatory framework, while striking an appropriate balance between the sustainability of the Spanish National Health System, timely patient access to medicines and the legitimate interests of the various stakeholders involved.
