Faus Moliner at the 2023 European Pharmaceutical Law Forum 2023

The 32nd edition of the Informa European Pharmaceutical Law Forum took place in Brussels on 24-26 May 2023.

As in other previous editions, various roundtables tackled key issues and developments in EU Pharmaceutical Law.

Jordi Faus, together with Ilja Moree (Novartis AG) and Kirsten Broeckers, (Novartis Gene Therapies GmbH), spoke about legal issues raised by new schemes in the relationship between pharmaceutical companies and public healthcare systems; advocating for moving from an easy “no” to a more challenging “favor libertatis” environment. In his presentation, Jordi presented some ideas on how to reconcile these schemes with public procurement rules, and briefly touched upon aspects related to competition law, compliance and transparency. The discussion also illustrated how the tendency for more sophisticated marketing authorizations and price and reimbursement rulings may facilitate these new schemes.
